Abstract
تسعى الدول جاهدة وراء تطوير الأسلحة بغرض الحصول على ميزة عسكرية فى مواجهة التهديدات بهدف حماية أمنها القومى، وهو أمر مشروع بلا شك؛ بل وضامن لاستمرار وجود الدولة ذاتها. إلا أن الدولة لا تتمتع بحرية كاملة فى اختيار التدابير لتحقيق ذلك وغير مقيدة بأى شرط؛ بل يجب أن يكون ذلك ضمن إطار القانون الدولى الإنساني الذي يفرض قيودًا صارمة على الأسلحة من حيث تطويرها واستخدامها، فيحظرها ابتداءً أو يقيد استخدامها فى أحوال معينة، وهنا تكمن فكرة التوازن بين الضرورة العسكرية والمبادئ الأساسية التي تحكم النزاع المسلح، مثل التناسب والتمييز وتجنب الإصابة الزائدة والمعاناة غير الضرورية.
ولقد كشفت الحرب على غزة عن أزمة عميقة يواجهها القانون الدولى بصفة عامة والقانون الدولى الإنساني بصفة خاصة. ولقد أدى الاعتماد على أسلحة تعتمد على الذكاء الاصطناعى خلال هذه الحرب من أجل استهداف رجال المقاومة الفلسطينية إلى تساؤلات جوهرية عن جدوى قواعد تم الاتفاق عليها بين الدول الإمبريالية لتعالج أزمة إنسانية مرت بها أوروبا خلال القرن التاسع عشر لتكون صالحة للتطبيق وكافية لمواجهة المآسى التي يشهدها قطاع غزة اليوم. وبصفة أساسية، يسعى هذا البحث إلى تسليط الضوء على التحديات المرتبطة بإسناد قرار الحياة والموت إلى الذكاء الاصطناعى، وبيان مدى كفاية قواعد القانون الدولى الإنساني، باعتباره الإطار القانوني الرئيسي المتفق عليه من قبل الدول لتنظيم السلوك في النزاعات المسلحة، الحماية اللازمة من استخدام تلك الأسلحة.
