مستقبل حماية الملكية الفكرية بين القانون الدولي والتقنيات الناشئة

الملخص

تطوّرت حماية حقوق الملكية الفكرية بشكل ملحوظ منذ اعتماد اتفاقيتي باريس وبيرن. ومع العولمة، والتطورات الرقمية، والتجارة الدولية، أصبح قانون الملكية الفكرية يتناول قضايا معقدة مثل القرصنة، والتقليد، ونقل التكنولوجيا، وإتاحة الابتكار. وتتناول هذه الدراسة أهم المعاهدات الدولية، وإجراءات الإنفاذ، والتحديات الناشئة، والحلول المقترحة، مع التركيز بوجه خاص على الأطر الإقليمية، ومبادرات المنظمة العالمية للملكية الفكرية (الويبو)، واتفاقية تريبس (TRIPS). كما تولي الدراسة اهتمامًا خاصًا بمواءمة حماية الملكية الفكرية بين مختلف النظم القانونية، وتعزيز سهولة الوصول، وحل النزاعات القانونية العابرة للحدود.


تهدف الأطر القانونية الدولية إلى مواءمة القوانين الوطنية الخاصة بالملكية الفكرية مع المعايير العالمية، بما يسهم في تمكين أصحاب الحقوق من حماية حقوقهم وإنفاذها على نطاق عالمي. ومن خلال التعاون الدولي، وتقديم المساعدة الفنية، وتبادل البيانات، تصبح الدول أكثر قدرة على التصدي لانتهاكات الملكية الفكرية. وتعتمد الدراسة منهجًا وصفيًا لتوضيح الحماية التي توفرها الاتفاقيات الدولية، ومنهجًا تحليليًا لتقييم فعاليتها العملية، كما تتضمن دراسات حالة لتقديم تقييم شامل لتأثير الأدوات القانونية الدولية على إنفاذ الملكية الفكرية وتعزيز التعاون في هذا المجال.


وتؤكد الدراسة على أن الأطر القانونية الدولية، رغم ما أحرزته من تقدم كبير في حماية الملكية الفكرية، تواجه تحديات متزايدة نتيجة التسارع الكبير في وتيرة التطور التكنولوجي، ولا سيما مع صعود تقنيات الذكاء الاصطناعي وتقنية البلوك تشين. فهذه الابتكارات لا تطرح أشكالًا جديدة من الإبداع والانتهاك فحسب، بل توفر أيضًا أدوات مبتكرة للتسجيل، والتحقق، والمراقبة، والإنفاذ.


وبناءً على ذلك، تخلص الدراسة إلى أن مستقبل حماية الملكية الفكرية يكمن في الدمج التكيفي للحلول التكنولوجية ضمن النظم القانونية. وإن توظيف الذكاء الاصطناعي لرصد الانتهاكات، واستخدام تقنية البلوك تشين لتأمين وإثبات الملكية، يقدمان مسارًا نحو حوكمة أكثر فعالية وشفافية وشمولية لحقوق الملكية الفكرية على المستوى العالمي.
