المنظور القانوني حول استخدام التقنيات المستجدة في الانتخابات في أفريقيا

الملخص

تبحث هذه الورقة عن استقبال وتكامل واستخدام التكنولوجيات الجديدة في إعداد وإجراء وإدارة الانتخابات في أفريقيا. وتاريخياً، كانت الانتخابات تُجرى حسيا مادياً، ولكن بسبب عدم ثقة الناخبين في النظام، والسعي إلى التحديث وإيجاد طرق أفضل للقيام بالأمور، هناك اعتماد محموم للتكنولوجيات الجديدة في النظام الانتخابي. وعلى الرغم من أن الجماهير رحبوا بهذا النوع من التطور، إلا أن هذه الورقة تدعو إلى الحذر اذ كان انتشارالتقنيات الجديدة قد أثار ردود فعل متباينة، وسجل تقلبات ومنعطفات، وطرح تحديات جديدة. وتشمل هذه، مرحلة أخرى من فقدان ثقة الناخبين، والتكلفة الباهظة للحصول على التكنولوجيات الجديدة، والتقاضي العديد لشرعية الانتخابات، حتى في بعض البلدان المتقدمة التي يتم استخدام التكنولوجيات الجديدة فيها. وبالتالي فإن الفهم الأفضل للتقاطع بين التكنولوجيا والتصويت أمر ضروري وحتمي لاستجواب الظروف والبيئة القانونية التي تستخدم فيها أيضا التكنولوجيات المستجدة في أفريقيا، لنفهم  تلك الأسباب التي أدت الأمرإلى عواقب غير مقصودة. وتسعى هذه الورقة لتحقيق كل ذلك من خلال المنهج الفقهي للبحث القانوني.
