الملخص

تتناول هذه الدراسة موضوع الضمانات الإجرائية للمزادات الإلكترونية في البيع القضائي للسفن: دراسة مقارنة في ضوء التحول الرقمي للتنفيذ البحري، نظرًا للتطور المتسارع في مجال التنفيذ القضائي والاتجاه نحو استخدام الوسائل الرقمية في إجراءات البيع الجبري. حيث تنبع أهمية الدراسة من الطبيعة الفريدة للسفينة كأصل ذي قيمة اقتصادية وقانونية متميزة، وارتباطها بالعديد من الحقوق والامتيازات والديون البحرية، وأثر بيعها القضائي على المستوى الدولي. كما تهدف هذه الدراسة إلى توضيح مفهوم المزادات الإلكترونية في البيع القضائي للسفن، وخصائصها، وطبيعتها القانونية. كما تحلل الإطار التشريعي المنظم لها، وتحدد الضمانات الإجرائية المتعلقة بالإعلان عن المزاد، والتسجيل، والمشاركة، والتحقق من هوية المشاركين وأهليتهم، وصحة العروض، وإثبات توقيتها وترتيبها، وإرساء المزاد، وإثبات البيع. وتتناول الدراسة أيضًا الحجية القانونية للسجلات والمستندات والتوقيعات الإلكترونية، وتحدد الآثار القانونية للأعطال التقنية والمسؤولية الناشئة عنها، وتقيّم كفاية الضمانات القائمة في حماية حقوق الأطراف المعنية وتحقيق اليقين القانوني في ضوء الاتجاهات الدولية الحديثة، ولا سيما اتفاقية الأمم المتحدة لعام 2023 بشأن الآثار الدولية للبيع القضائي للسفن (اتفاقية بكين). تعتمد الدراسة المنهج التحليلي المقارن، المدعوم بالمنهج الوصفي، عبر تحليل التشريعات الوطنية والاتفاقيات الدولية والأحكام القضائية والفقه القانوني والدراسات السابقة، ومقارنة التشريع المصري بأنظمة قانونية مقارنة ذات صلة. خلصت الدراسة إلى أن المزادات الإلكترونية وسيلة فعالة لتطوير التنفيذ البحري بفضل سرعتها وشفافيتها واتساع نطاق المشاركة. كما أن القواعد التقليدية وحدها غير كافية لتلبية متطلبات البيئة الرقمية، مما يستلزم وضع ضمانات قانونية وإجرائية وفنية متكاملة لضمان سلامة العروض وحماية البيانات والتحقق من المشاركين ومعالجة الأعطال التقنية والحجية القانونية للمستندات والسجلات الإلكترونية. كما يتطلب تعزيز التوافق بين التشريعات الوطنية والاتجاهات الدولية لضمان الاعتراف بآثار البيع القضائي للسفن. وخلصت الدراسة إلى ضرورة وجود إطار تشريعي وإجرائي شامل ينظم المزادات الإلكترونية في البيع القضائي للسفن، يحقق توازنًا بين سرعة وكفاءة التحول الرقمي من جهة، وضمان المشروعية والشفافية وحماية حقوق الدائنين والمدينين والمشترين وأصحاب الحقوق البحرية من جهة أخرى.
