Abstract

This study examines the procedural safeguards of electronic auctions in the judicial sale of ships: a comparative study in light of the digital transformation of maritime enforcement. This is due to the rapid development in the field of judicial enforcement and the trend towards using digital means in compulsory sale procedures. The study's importance stems from the unique nature of the ship as an asset with distinct economic and legal value, its connection to numerous maritime rights, privileges, and debts, and the international impact of its judicial sale. This study aims to clarify the concept of electronic auctions in the judicial sale of ships, their characteristics, and their legal nature. It also analyzes the legislative framework governing them and identifies the procedural safeguards related to auction announcement, registration, participation, verification of participants' identities and eligibility, validity of bids, proof of their timing and order, auction award, and proof of sale. The study also addresses the legal validity of electronic records, documents, and signatures, identifies the legal implications of technical malfunctions and the resulting liability, and assesses the adequacy of existing safeguards in protecting the rights of stakeholders and achieving legal certainty in light of recent international trends, particularly the 2023 United Nations Convention on the International Effects of Judicial Sale of Ships (Beijing Convention). The study employs a comparative analytical approach, supported by a descriptive methodology, through the analysis of national legislation, international conventions, judicial rulings, legal scholarship, and previous studies, and by comparing Egyptian legislation with relevant comparative legal systems. The study concludes that electronic auctions are an effective means of developing maritime enforcement due to their speed, transparency, and broad participation. Traditional rules alone are insufficient to meet the demands of the digital environment, necessitating the establishment of integrated legal, procedural,
